Responsum by the Gaon Rabbi Chaim Moda'i, Av Beit Din of Izmir, 1791

Halachic responsum from the gaon Rabbi Chaim Moda'i, Av Beit Din of Izmir, to the rabbi of Magnesia, Rabbi Rephael Avraham Matzliach, author of Ma'amar HaMelech.

The responsum deals with an event which occurred in Magnesia (Turkey), when someone who drew "mayim shelanu" towards evening to bake matzah, and at midnight he awoke and used it to knead the matzah dough - before the water stayed over an entire night.

To the best of our knowledge, this responsum was not printed in Rabbi Chaim Moda'i's responsa Chaim L'Olam (Izmir 1879) and not in the inquirer's book Ma'amar HaMelech (Salonika 1806).

The gaon Rabbi Chaim Moda'i [1720-1794] was one of the greatest Sephardic sages of his generation, and a close friend of the Chida's. He was a rabbi in Constantinople, Izmir and Safed. He ascended from Constantinople to the Land of Israel, settled in Safed and traveled as an emissary. He was appointed chief rabbi of Izmir in 1773, but that same year he returned to Safed, and he passed away there. During his mission, he visited Prague and negotiated with the author of Noda BiYehudah. Refer to: Shu"t Noda BiYehudah, first edition, Yoreh Deah, siman 87-88 and his book Chaim L'Olam Part I, Yoreah Deah, siman 2. (Also refer to Shluchei Eretz Yisrael pp. 451).

[1] leaf paper, 15x21 cm, written on both sides. Oriental script. Scribal script with a concluding line in Rabbi Chaim Moda'i's handwriting and with his signature; moderate condition. Worming damage.
