Halachic Answer Concerning Torah Scrolls Brought by Holocaust Survivors – Rabbi Saul Yisraeli – 1978
A question regarding non-kosher Torah Scrolls which were brought by Holocaust survivors to the synagogue, but their owners' name is unknown – if is possible to fix them and make them kosher and to dedicate the cover of the ark in the name of the person who fixes them. At the end of the question letter there is an additional p.s: “I am writing with the knowledge of the local Rabbi, Rabbi Natan Tzvi Friedman may he live and be well, who expressed the opinion that as the Rabbi of the place he is subjective and does not want to rule.”
The questioner, Reb Shlomo Zimroni, was the head of the Religous Council of Bnei Brak, and the sexton of the synagogue in Shikun Hey there.
Rabbi Yisraeli ruled that the synagogue is allowed to send the Torah scrolls to be fixed and to dedicate the curtain of the Ark to the person who fixed them, but this is on condition that if the owners should arrive, they will be willing to compensate them as a Beit Din sees fit, and also on the condition that on the curtain of the Ark will be written that the Torah Scrolls were saved from the Holocaust and fixed by the person who fixed them.
Rabbi Shaul Yisraeli (1909 – 5755) was one of the greatest Halachic rulers of the previous generation. He wrote many scholarly works in Jewish law, legend and Jewish Philosophy. He was the rabbi of Kfar Ha'Roeh, a Dayan on the Beit Din HaGadol, a member of the council of the Chief Rabbinate, Rosh Yeshiva of Yeshivat 'Mercaz HaRav', the head of the council of Rabbis of HaPoel HaMizrachi, the editor of the journal 'HaTorah veHaMedina' a Halachic ruler to the religious settlements with regard to the Mitzvot which are applicable only in the Land of Israel.
